INTRODUCTION
|
|
These terms and conditions form the basis of the ShawlandScarf.com e-Cash Coupon Redemption promotion (Promotion) and govern the use of the ShawlandScarf.com Bonus Points and e-Cash Coupon by ShawlandScarf customers. Information on how to subscribe as ShawlandScarf.com member, and General Terms and Conditions for Participation, and any terms and conditions published on the ShawlandScarf.com website, form part of these terms and conditions.

SHAWLANDSCARF THANK YOU CARD
|
- Customers of ShawlandScarf who wish to get bonus points from their purchases in ShawlandScarf eBay Auction and ShawlandScarf.com, and to redeem the e-Cash Coupon, must subscribe the membership of ShawlandScarf.com, and in doing so they agree to be bound by these terms and conditions. Only individuals may hold the account of the ShawlandScarf.com membership at any one time. By subscribing as ShawlandScarf.com member, the customers agree their auction histories and order records be displayed in the database of ShawlandScarf.
- ShawlandScarf.com may reject or refuse any membership enrolment at its discretion.
- ShawlandScarf may cancel any membership at any time without notice and for any reason, including (without limitation) if the member fails to comply with these terms and conditions; supplies any misleading information or makes misrepresentations to ShawlandScarf; dies or becomes bankrupt; fails to comply with the terms on which any the bonus point is offered; or abuses any privilege accorded to a member.

EARNING BONUS POINTS
|
- A member will earn 10 bonus points for every $50 spent at ShawlandScarf.com or ShawlandScarf Auction. If the purchase amount is less than $50, ShawlandScarf will reward the customer 2 bonus points. Purchases will be rounded to the nearest full $1 spent. Bonus Points will be recorded in the ShawlandScarf database and into a customer's account held by ShawlandScarf.com. The above scheme can be altered by ShawlandScarf at anytime with or without notice to the customers for any reason.
- The redemption of the Bonus Points to e-Cash Coupon is according to the ShawlandScarf Exchange Rate. The Exchange Rate is not a static rate. ShawlandScarf has the right to alter the Exchange Rate at any time without notice and for any reason. The e-Cash Coupon can be used wholly or partly in those purchases on ShawlandScarf.com, but will not include shipping charges, handling charges, tax, and those ShawlandScarf products in ShawlandScarf eBay Auction.
- Approved Payment Means are those methods of payment approved by ShawlandScarf.com in its sole discretion from time to time.
- Bonus Points and e-Cash Coupon have no cash or monetary value and cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these terms and conditions.
- ShawlandScarf is not responsible for any technical or other error or failure which results in Bonus Points and e-Cash Coupon not being recorded by ShawlandScarf.com.
- The face of the ShawlandScarf Thank You Card will display the Bonus Points earned for the last qualifying purchase made and the customer's total Bonus Points. It is the customer's responsibility to ensure the Bonus Points displayed on the face of the Thank You Card are correct. If there is a discrepancy between the Total Bonus Points displayed on the face of a Thank You Card, and the total Bonus Points recorded in the ShawlandScarf database and the customer's Account, the Bonus Points as recorded in the ShawlandScarf database and in the customer's Account shall prevail.
- After e-Cash Coupon Redemption, the Total Bonus Points will be deducted and the customer may recommence earning Bonus Points. ShawlandScarf may deduct Bonus Points from a customer's Account where the Bonus Points have been recorded in error.

REDEMPTION OF ECASH COUPON BASED ON BONUS POINTS
|
- A customer who has accumulated sufficient Bonus Points to reach a Redemption Level, can redeem e-Cash Coupon based on the ShawlandScarf Exchange Rate displayed in the ShawlandScarf.com
- The maximum and minimum amount of Bonus Points in each Redemption should be according to the ShawlandScarf.com
- The e-Cash Coupon have no cash or monetary value and can not be sold, transferred, assigned or otherwise dealt with except in accordance with these terms and conditions.
- If a refund of a purchase made wholly or in part with e-Cash Coupon is made (in line with ShawlandScarf refund policy), that part of the purchase made with e-Cash Coupon will not be refunded.
- If a purchase made wholly or in part with e-Cash Coupon, the Bonus Points earned from that purchase will be based on the amount of payment deducted from the part paid with e-Cash Coupon. If the purchase made wholly with e-Cash Coupon, there will be only 2 Bonus Points generated by that purchase.
- If a customer choose to use the e-Cash Coupon in a purchase, it is to use all the e-Cash Coupon that customer possessed by the time. If the amount of the e-Cash Coupon is larger than the price of the item, the remaining value of the e-Cash Coupon will be preserved in the customer's account. The customer cannot define the amount of the e-Cash Coupon to be used in any purchase.

VARIATION OR CHANGE OF TERMS AND CONDITIONS
|
- ShawlandScarf reserves the right to vary the terms and conditions, or suspend or terminate the Promotion at any time without prior notice.
- Without limiting clause 8.1, ShawlandScarf may at any time in its absolute discretion and without notice, cancel Bonus Points, introduce an expiry date for use of Bonus Points and e-Cash Coupon, or make any other change which has the effect of changing Bonus Points credited to or may be credited to a customer's account.
- Without limiting clause 8.1, ShawlandScarf may at any time in its absolute discretion and without notice modify or otherwise change which goods or services are Qualifying Purchases, the number of Bonus Points that will be obtained from a purchase, what payment means are Approved Payment Means for earning Bonus Points, and the ShawlandScarf Exchange Rate.
- ShawlandScarf will endeavour to advise ShawlandScarf members of information about the Promotion (such as any changes of the kind listed above), but ShawlandScarf will not be liable for any failure to do so.

NOTICE
|
- Any notice to a customer regarding the Bonus Point and e-Cash Coupon will be posted to ShawlandScarf.com.
|
|
LIMITATION OF LIABILITY
|
- All conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Promotion are expressly excluded to the full extent permitted by law. Any liability ShawlandScarf may have to a customer in respect of such goods or services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again.
- ShawlandScarf is not liable for: any use of the e-Cash Coupon by a person other than the account holder of a customer and any benefits derived from the use of the Bonus Points and e-Cash Coupon by that other person; any delay, failure or inability to accurately record the details of any transaction or credit Bonus Points to a customer; any loss of data or theft of or hack to the database of the Bonus Points and e-Cash Coupon; any correspondence between ShawlandScard and the customer lost or delayed in the mail; the suspension or termination of the Promotion; any disruption to the Promotion or any delay or inability to provide any Bonus Points and e-Cash Coupon caused by circumstances beyond the control of ShawlandScarf.

PRIVACY POLICY

- ShawlandScarf respects your rights to privacy and the collection of personal information from individuals.
- The personal information collected under the ShawlandScarf includes your name, address, contact telephone numbers and email address which is required to enable us to properly conduct the Bonus Points and e-Cash Coupon program, and the delivery of products. It is optional for you to provide us with any additional personal information contained in the enrolment form. You will be eligible to automatically receive the ShawlandScarf Newsletter (if any) and other related direct marketing material either by post or email. If you indicate on the application form, or at any time thereafter, that you do not wish to receive this, it will not be sent to you.
- We will not disclose personal information collected about you to any other party except to ShawlandScarf eBay Auction and ShawlandScarf.com, for the purpose of managing our database.

RESOLUTION OF DISPUTES
|
- Any question or dispute regarding the Promotion or which arises in connection with a customer's participation in the Promotion, will be resolved by ShawlandScarf in its sole discretion.
